Bento Buds (ABN 17 695 636 876) ("Bento Buds", "we", "us" or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, hold, use and disclose personal information through our website bentobuds.com.au (the "Site"), in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

By using our Site or providing us with your personal information, you agree to the terms of this Privacy Policy.

1. What personal information we collect

Depending on how you interact with us, we may collect:

  • Contact and identity information — name, email address, phone number, billing and delivery address.
  • Order and transaction information — products purchased, order value, order history, and payment confirmation details (we do not store full card numbers — see section 7 below).
  • Account information — if you create an account with us, your login details and saved order/address history.
  • Marketing preferences — whether you've subscribed to our email marketing and your engagement with our emails (opens, clicks).
  • Technical and usage information — IP address, browser and device type, pages viewed, referral source, and how you interact with our Site, collected via cookies and similar tracking technologies (see section 5).

  • from third-party service providers who help us operate our Site and process your orders, such as Shopify, our payment providers, and our analytics and advertising partners (see sections 6 and 7).

3. Why we collect, hold, use and disclose your information

We use your personal information to:

  • process and fulfil your orders, including arranging payment and delivery;
  • create and manage your account, if you have one;
  • respond to your enquiries and provide customer support;
  • send you order updates and transactional communications;
  • send you marketing communications about our products, promotions and content, where you have opted in (and to let you opt out at any time — see section 6);
  • improve our Site, products and customer experience, including through analytics; and
  • meet our legal, accounting and regulatory obligations.

We will not use or disclose your personal information for any other purpose without your consent, unless required or authorised by law.

4. Cookies and tracking technologies

Our Site uses cookies and similar tracking technologies to operate effectively and to understand how visitors use our Site. This includes:

  • Essential cookies used by our e-commerce platform, Shopify, to enable core site functionality such as your shopping cart and checkout.
  • Analytics cookies via Google Analytics, which help us understand site traffic and visitor behaviour in aggregate.
  • Advertising cookies/pixels via the Meta Pixel (Facebook/Instagram), which help us measure the performance of our ads and show you more relevant ads on Meta platforms.

You can control or disable cookies through your browser settings, though this may affect how our Site functions. Where you interact with our ads on Meta platforms, Meta's own privacy policy also applies to information collected via the Meta Pixel.

5. Direct marketing

If you subscribe to our mailing list (managed through Shopify Email) or otherwise opt in, we may send you marketing emails about new products, promotions and content. Every marketing email includes an unsubscribe link, and you can opt out at any time by:

6. Disclosure to third parties

We disclose personal information to trusted third parties who help us run our business, including:

  • Shopify Inc. — our e-commerce platform provider, which hosts our Site and processes orders, accounts and email marketing.
  • Payment providers — including Shopify Payments and the payment methods available at checkout (credit card, debit card, Apple Pay and Google Pay), to process your payment securely. We do not see or store your full card details — these are handled directly by our payment providers.
  • Shipping and logistics providers — to deliver your order.
  • Google LLC — for website analytics via Google Analytics.
  • Meta Platforms, Inc. — for advertising and ad performance measurement via the Meta Pixel.

These providers are only permitted to use your information to provide their services to us, and are subject to their own privacy policies.

We do not sell your personal information to third parties.

7. Overseas disclosure

Some of the third parties listed above are based, or store and process data, overseas — principally in the United Statesand Canada (where Shopify is headquartered). This means your personal information may be held or processed outside Australia.

Where we disclose personal information to overseas recipients, we take reasonable steps to ensure those recipients handle your information in a manner consistent with the Australian Privacy Principles, including by relying on the data protection terms and safeguards offered by these established global platforms (Shopify, Google and Meta).

8. Data security

We take reasonable steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification or disclosure. This includes relying on the security infrastructure of reputable platforms (such as Shopify's PCI-compliant checkout) and restricting access to personal information to those who need it to perform their role.

No method of transmission or storage is 100% secure, and we cannot guarantee absolute security of information transmitted to us.

9. Access and correction

You can request access to, or correction of, the personal information we hold about you at any time by emailing us at hello@bentobuds.com.au. We will respond to your request within a reasonable timeframe. We may need to verify your identity before providing access to, or correcting, your information.

If you have an account with us, you can also view and update most of your information directly via your account settings.

10. Children's privacy

Our products are designed for parents and carers to purchase for children, but our Site is intended for use by adults, and we do not knowingly collect personal information directly from children. Any information about a child (for example, a name used on a delivery label) is provided to us by the purchasing adult and is used solely for fulfilling your order.

We may update this Privacy Policy from time to time to reflect changes in our practices or legal obligations. The updated version will be posted on this page with a revised "Last updated" date. We encourage you to review this policy periodically.
